Agreeing to these terms
These terms cover your use of the Excel Newton Concrete website and any work you hire us to do. When you use our website, ask for an estimate or book a job, you agree to them, so please read them first.
If you don't agree with these terms, please don't use the site or book work with us. A signed contract for your job may add to these terms, and where the two differ, the contract wins.
Who we are and what we do
Excel Newton Concrete is a concrete contractor in Newton, MA, and we work in Newton and the cities around it. We build and repair driveways, patios, walkways, steps, garage floors, foundations, footings, retaining walls and other concrete work. We're fully licensed and insured, and you can read more about our crew on our About page.
What you read on this site is general information about concrete work, not a promise about your property. Every job depends on the ground, drainage and access we find when we come out.
Estimates and pricing
Our estimates are free and done in person, and you're under no obligation to hire us. We price the job on what we see at the visit. That includes the size of the area, the condition of the old slab, how much digging and base work it needs, how easily the truck can reach it and the finish you pick.
An estimate's price holds for the time written on it. Sometimes we open up a job and find something nobody could see beforehand, like soft soil, buried debris or roots under the old slab. When that happens, we stop, show you, and agree on any change in writing before we do the extra work.
Nothing on this website is a quote for your job. Only a written estimate or contract from us sets your price.
Scheduling, weather and cancellation
Once the work is agreed, we give you a start date and do our best to keep it. We may move a pour if heavy rain or freezing weather would put the new slab at risk, and we'll let you know as soon as we see it coming. Supply delays and site conditions can move the date too.
If you need to cancel or reschedule, please call us at (617) 644-7325 as early as you can. After we've ordered concrete or materials for your job, or our crew has started, you may owe the costs we can't get back, as your contract states. Any right to cancel that Massachusetts law gives you still applies.
Payment
Your written estimate or contract sets the price, any deposit and when each payment is due. Unless it says otherwise, the balance is due when the work is finished, and we'll tell you which payment methods we accept before the job starts.
If a payment is overdue, we may pause any remaining work until it's paid. Where the law allows, we may also charge reasonable costs of collecting it.
Your part of the job
You confirm that you own the property or have the owner's permission for the work. Please give our crew access, move cars and belongings out of the work area, and tell us what you know about buried lines, sprinklers, drain pipes or past problems with the ground.
Keep people, pets and vehicles off new concrete until we tell you it's ready. Concrete keeps hardening for days after the pour, and weight on it too soon can mark or crack it.
Our guarantee and what it doesn't cover
We stand behind our work, and satisfaction is guaranteed on every job. If something isn't right, call us and we'll come look at it. Any written warranty for your job is the one in your contract. To the extent the law allows, it replaces any other warranty, spoken or implied.
Concrete shrinks as it dries and moves with the seasons, so fine cracks are normal. We cut control joints, grooves that give the slab a planned place to crack, so that most cracks stay in those lines. Hairline cracks outside them aren't a defect.
Our guarantee doesn't cover damage from use before the slab is ready, de-icing salts, loads the slab wasn't built for, tree roots, or soil and drainage changes after we leave. It also doesn't cover work changed or repaired by someone else.
This website and its content are provided "as is," without any warranty that they're complete or error-free.
Limits on our liability
To the extent the law allows, Excel Newton Concrete isn't liable for indirect or follow-on losses. These include losing the use of your driveway, lost income, or damage to items left in the work area after we asked for them to be moved. Our total liability for any claim about a job is limited to the amount you paid us for that job.
Nothing in these terms limits any liability that the law doesn't let us limit, or takes away any right you have as a consumer under Massachusetts law.
Settling a disagreement
If you have a problem with our work or a bill, please call us first at (617) 644-7325. Most issues get sorted out with a visit to the site.
If we still can't agree, we'll both consider mediation before either of us goes to court. Any claim that isn't settled will be decided in the state courts of Massachusetts.
Which law applies
These terms, your use of this website and any work we do for you are governed by the laws of the Commonwealth of Massachusetts.
Changes to these terms
We may update these terms from time to time. The version posted on this site is the one that applies when you use it. A change won't alter a contract you've already signed with us.
If you have a question about these terms, call us at (617) 644-7325 or send us a note through our contact page.
